1. Agreement to Terms
This Agreement is a binding contract between “Seller” (you) and MilesBuyer.com (“MilesBuyer,” “we,” or “us”). By submitting a quote request, providing your account information, or electronically signing an Order, you agree to these terms. If you do not agree, do not use our services.
2. Transaction Process
- 2.1 Quotes & Acceptance: Price quotes issued by MilesBuyer remain valid for 48 hours. We reserve the absolute right to reject any quote, account, or transaction for any reason at our sole discretion, even after a quote has been issued.
- 2.2 Identity Verification: To prevent fraud, the name on the mileage account must match the name on the receiving payment account (PayPal, bank account, etc.), unless we expressly agree to an accommodation in writing.
- 2.3 Expiration Policy: We do not purchase miles or points that differ from our requirements or that are scheduled to expire within six (6) months of the transaction date. You are required to notify us immediately if your miles are subject to expiration within this timeframe. Failure to disclose imminent expiration constitutes a material breach of this Agreement.
3. Account Access & Delegate Authority
- 3.1 Delegate Access Only: MilesBuyer does not purchase ownership of your personal account. Instead, you grant us delegate access solely for the specific purpose of redeeming the agreed-upon miles for travel bookings. You retain ownership of the account itself.
- 3.2 Seller Obligations: You represent and warrant that:
- Credentials: You will provide valid login credentials immediately upon request or payment to facilitate our delegate access.
- No Interference: You will not change the password, lock the account, or use any of the sold miles yourself while we are accessing the account.
- Authority: You have the legal authority to grant this access and sell these miles.
4. Payment Terms
- Method: Payments are processed via PayPal, Check, or e-Check.
- Timing: While MilesBuyer generally remits payment upon verification of the account, we reserve the right to pay only after the successful redemption of miles for certain transaction types.
- Taxes: You are solely responsible for all income and sales taxes associated with this transaction.
5. Fraud, Refunds, and Clawbacks
- Refunds: If your account is restricted, frozen, or audited—or if the miles are revoked—you must immediately refund the full purchase price to MilesBuyer.
- Fraud Warning: If you accept payment and subsequently restrict our access to the account or recover the miles, MilesBuyer will treat this as fraud in the inducement and wire fraud. We will pursue all legal remedies to recover funds, including costs and attorney fees.
- Indemnification: You agree to indemnify MilesBuyer against any third-party claims or damages resulting from your breach of this Agreement or violation of airline program rules.
6. SMS/Text Message Terms
By providing your phone number, you expressly consent to receive text messages from MilesBuyer regarding your quotes, account verification, and transaction status.
- Consent: Consent is not a condition of purchase.
- Rates & Frequency: Message and data rates may apply. Message frequency varies.
- Opt-Out: Reply STOP to cancel. Reply HELP for help.
- Carrier Liability: Mobile carriers (including T-Mobile, AT&T, and Verizon) are not liable for delayed or undelivered messages.
7. Limitation of Liability
To the fullest extent permitted by law, MilesBuyer’s liability is limited to the total purchase price paid for the miles. We are not liable for indirect, incidental, or consequential damages, including lost profits or data.
8. Governing Law & Dispute Resolution
- Florida Law: This Agreement is governed by the laws of the State of Florida.
- Venue: Any disputes shall be litigated exclusively in the state or federal courts of Miami-Dade County, Florida.
- Class Action Waiver: You waive any right to participate in a class or mass action lawsuit against MilesBuyer.
